Terms of Service

Please read these Terms of Service ("Terms") carefully before using Tsunu AI ("the Service"). "We," "us," and "our" refer to Tsunu AI, a limited liability company organized under the laws of the State of Delaware, USA.

1. Acceptance of Terms

By creating an account or using the Service in any way, you agree to be bound by these Terms. If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Tsunu AI is a SaaS platform that provides AI-powered business assistants — including tools for content creation, financial operations, sales, marketing, and more — powered by large language model technology. The Service is accessed via a web application at app.tsunu.ai and the marketing site at tsunu.ai.

3. User Accounts and Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must:

• Provide accurate and complete registration information
• Keep your password secure and notify us immediately of any unauthorized access
• Not share your account with others or create accounts on behalf of individuals who have not agreed to these Terms
• Be at least 18 years of age

We reserve the right to suspend or terminate accounts that are found to be in violation of these Terms.

4. Acceptable Use

You agree not to use the Service to:

• Generate or distribute illegal, harmful, harassing, defamatory, obscene, or otherwise objectionable content
• Violate any applicable law or regulation
• Infringe the intellectual property rights of others
• Attempt to reverse-engineer, decompile, or disassemble the Service or its underlying models
• Circumvent rate limits, access controls, or security measures
• Use automated scripts to scrape or extract data from the Service
• Resell or sublicense access to the Service without our written permission

We reserve the right to remove content and suspend accounts that violate this policy. Repeated or severe violations may result in permanent termination.

5. Subscription and Billing

Plans

The Service is offered on subscription plans (Basic, Standard, Premium). Current pricing is available at tsunu.ai.

Free trial

New accounts include a 14-day free trial. No payment method is required to start. At the end of the trial period your access will be limited to free features unless you subscribe.

Billing and renewal

Subscriptions are billed monthly or annually in advance. Your subscription auto-renews at the end of each billing period at the then-current rate; Stripe charges your payment method on the first day of the new period unless you cancel before the renewal date.

Cancellation

You may cancel your subscription at any time from Settings → Billing. Cancellation takes effect at the end of the current billing period; you retain access until then.

Refunds

We do not offer prorated refunds for unused time in a billing period. If you believe a charge was made in error, contact billing@tsunu.ai within 30 days.

Fee changes

We may change subscription fees at any time with reasonable prior notice by email or in-platform announcement. Fee changes take effect at the end of your current billing cycle — you will not be charged the new rate mid-cycle.

6. Intellectual Property

Your content

You retain ownership of all content you submit to the Service ("your content"). By submitting content you grant us a limited, non-exclusive, royalty-free license to process it solely for the purpose of providing the Service to you.

The Vault and Personas

You own all data stored in the Vault, including Personas you create. Vault content and Personas are not used to train AI models and are not shared with third parties except as necessary to route your active AI request to a provider. You may export or delete Vault data at any time. Deletion timelines are governed by our Privacy Policy.

Our platform

The Tsunu AI platform, including its software, design, trademarks, and all content we create, is owned by Tsunu AI and protected by applicable intellectual property laws. You may not copy, reproduce, modify, or distribute any part of the platform without our prior written consent.

AI outputs

Content generated by the AI assistants on your behalf is provided for your use. We make no representation that AI-generated content is free of third-party intellectual property claims, accurate, or suitable for any particular purpose. You are responsible for reviewing and verifying any AI-generated content before use.

Feedback

If you submit feedback, suggestions, bug reports, or ideas about the Service ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, and incorporate that Feedback into the Service for any purpose without compensation to you. Submitting Feedback does not give you any intellectual property rights in the Service or in any resulting improvements.

7. DMCA and Copyright Infringement

We respect the intellectual property rights of others and expect users to do the same. If you believe content on the Service infringes a copyright you own or control, send a written notice to our copyright agent containing:

• Identification of the copyrighted work claimed to have been infringed
• Identification of the infringing material and information sufficient to locate it on the Service
• Your contact information (name, address, phone, and email)
• A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
• A statement, under penalty of perjury, that the information is accurate and that you are the copyright owner or authorized to act on the owner's behalf
• Your physical or electronic signature

Send DMCA notices to legal@tsunu.ai (subject line: "DMCA Notice"). We will respond to valid notices as required by the Digital Millennium Copyright Act.

8. Your Data

Project data retention

Project Data Retention

When you delete a project, all associated data — including Vault entries, assistant history, and brand voice settings — is scheduled for permanent deletion. Deleted project data is retained for 30 days from the date of deletion, during which time it cannot be accessed but may be recoverable upon request to support@tsunu.ai. After 30 days, the data is permanently and irreversibly deleted. We are unable to recover data after the 30-day retention window has expired.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TSUNU AI AND ITS OFFICERS, DIRECTORS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED US DOLLARS ($100).

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law provisions. Any dispute arising under these Terms shall be resolved exclusively in courts of competent jurisdiction in the State of Delaware, and you consent to personal jurisdiction there.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes we will notify you by email or by a prominent notice on the platform at least 14 days before the changes take effect. Your continued use of the Service after that date constitutes acceptance of the updated Terms.
